FAA Procedures for Penalties and Fines

The following is a possible scenario of a matter involving a violation of FAA air shipment regulations. 

  1. The FAA discovers a possible violation.  This can occur from an airline or shipping company suspecting and reporting the violation.
  2. An FAA agent investigates the matter and determines whether to issue a warning or proposed fine.
  3. The FAA can issue a formal Notice of Proposed Civil Penalty and demand payment of the fine.

The alleged violator then has several options including 

  1. Payment of the penalty
  2. Requesting a formal hearing to deny the violation
  3. Requesting an Informal conference and negotiating a lower fine.
